Welcome to the Owl + Fox online store. By accessing or using shop.owlandfox.co.za (the "Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site.

1. About us

The Site is operated by Owl + Fox ("Owl + Fox", "we", "us", "our"), a furnishings and interiors business based in Pretoria, South Africa. These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

2. Use of the Site

You may use the Site for lawful purposes only. You may not use the Site in any way that is fraudulent, that infringes the rights of others, or that could damage, disable, or impair the operation of the Site. We may suspend or terminate access to the Site at any time without notice.

3. Products, pricing and availability

All prices are displayed in South African Rand (ZAR) and include VAT unless stated otherwise. We take care to describe and photograph our products accurately, but natural materials such as timber, leather, stone, and hand-woven textiles vary from piece to piece; minor variations in colour, grain, and texture are characteristic of the product and do not constitute defects. Product availability, prices, and specifications may change without notice. An order is only accepted once we confirm it and payment has been received; we may decline or cancel an order (with a full refund) where a pricing or stock error has occurred.

4. Made-to-order and bespoke items

Certain items are made to order or commissioned as bespoke pieces. Lead times quoted for these items are estimates given in good faith. Bespoke commissions are made to your specification and are subject to the exclusions set out in our Return Policy.

5. Payment

Payment is processed through secure third-party payment providers. We do not store your full card details. You warrant that you are authorised to use the payment method you provide.

6. Delivery and risk

Delivery timeframes shown at checkout are estimates. Risk in the goods passes to you on delivery. Please inspect goods on receipt and notify us of any visible damage as soon as reasonably possible.

7. Returns

Returns, refunds, and exchanges are handled in accordance with our Return Policy, which forms part of these terms.

8. Intellectual property

All content on the Site — including text, images, photography, graphics, logos, and design — is owned by or licensed to Owl + Fox and is protected by South African and international intellectual property law. You may not reproduce, distribute, or exploit any content from the Site for commercial purposes without our prior written consent.

9. Privacy

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). We collect only the information needed to process your orders and communicate with you, and we do not sell your personal information to third parties.

10. Limitation of liability

To the extent permitted by law, and without limiting your statutory rights under the CPA, Owl + Fox shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or any products purchased through it. Nothing in these terms limits any liability that cannot lawfully be limited.

11. General

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. We may update these terms from time to time; the version published on the Site at the time of your order applies to that order.
